Regulatory Technical Standards on prudential requirements for investment firms

  • Status: Final draft RTS/ITS adopted by the EBA and submitted to the European Commission

The EBA developed these Regulatory Technical Standards in successive stages to support the implementation of the new prudential framework for investment firms under the Investment Firms Regulation (IFR) and Investment Firms Directive (IFD). The initial package, published in 2020, established the main technical requirements for the calculation of capital requirements and the reclassification of certain investment firms as credit institutions. The framework was subsequently finalised and complemented by requirements on the prudential consolidation of investment firm groups, published in 2023.

The 2026 review of the RTS on the reclassification of investment firms as credit institutions clarifies the calculation and monitoring of the EUR 30 billion total assets threshold and related reporting requirements, and introduce, for the first time, elements for competent authorities to consider when granting a waiver from the requirement to hold a credit institution authorisation. This review aims to ensure that the framework remains proportionate and risk-based and reflects developments in the EU prudential framework.
