Breach of Union Law

Article 17 of the EBA’s founding regulation gives the EBA power to investigate potential breaches of Union law (BUL) by competent authorities, including competent authorities within the Member States and the European Central Bank (ECB) under the Single Supervisory Mechanism (SSM). This serves the goal of ensuring the application of Union law. Where the EBA finds a BUL, it issues a recommendation on the actions to be taken by the competent authority to rectify the situation. Under Article 17, if the EBA finds a BUL, this may lead to further action by the European Commission.
