CEBS organises a public hearing on its consultation paper on the Guidebook on Internal Governance
The Committee of European Banking Supervisors (CEBS) has published today its draft consultation paper on the Guidebook on Internal Governance (CP 44) aiming at enhancing and consolidating supervisory expectations in order to improve the sound implementation of internal governance arrangements.

CEBS submits its initial views for a public consultation which starts today and runs until 14 January 2011. The consultation is open to all interested parties, including supervised institutions and other market participants. Comments received will be published on CEBS’s website unless respondents request otherwise. Please send your comments to the following email address: cp44@c-ebs.org.

A public hearing will be held on 15 December 2010 at CEBS’s premises in London, from 10:00 to 13:00 to allow interested parties to share their views with CEBS.

CEBS expects its members to implement the Guidebook on Internal Governance and to incorporate it within their supervisory procedures by 30 September 2011. After that date, members should ensure that institutions comply with it effectively.

CEBS organises a public hearing on its draft Guidelines on Remuneration Policies and Practices(CP42)

The Committee of European Banking Supervisors (CEBS) published its draft guidelines on Remuneration Policies and Practices.

CEBS would like to draw attention to a number of areas where it would particularly welcome views. These include: retention period, as outlined in paragraph 125 onwards where comments on the appropriate retention period are sought; and minimum portion of instruments and their distribution as outlined in paragraph 130, where it is CEBS understanding that it is the EU legislators’ intention that the 50% minimum threshold for instruments applies equally to the non-deferred and the deferred parts.
 

CEBS submits its initial views for a public consultation, starting on 8 October and running until 8 November 2010. Comments received will be published on CEBS’ website unless respondents request otherwise. Please send your comments to the following email address: CP42@c-ebs.org.

The consultation is open to all interested parties, including supervised institutions and other market participants. A public hearing will take place on 29 October 2010, from 10:00 to 13:00, at CEBS’s premises in order to allow all interested parties to present their comments.

The Committee of European Banking Supervisors (CEBS) has published its consultation paper (CP40) on guidelines to the new Article 122a of the Capital Requirements Directive (CRD).

Article 122a of the CRD provides new requirements to be fulfilled by credit institutions when acting in a particular capacity, such as originator, sponsor, or original lender and also when investing in securitisations. These  include retention - on an on-going basis - of a material net economic interest of not less than 5% (so called “skin in the game”), due diligence and, disclosure.

The Committee of European Banking Supervisors (CEBS) organises a public hearing in London on 28 June 2010 (from 10:30 to 12:30) to preview the findings of this year’s follow-up work assessing banks’ transparency. CEBS will present the findings of its analysis of disclosures provided i) in banks’ 2009 audited annual reports and ii) under Pillar 3 and seek the industry’s views on these conclusions prior to the reports' publication.

CEBS organises a public hearing on its draft guidelines(CP39) on joint assessment and joint decision regarding the capital adequacy of cross border groups
CEBS published in April 2010 for consultation draft Guidelines for the joint assessment of the elements covered by the supervisory review and evaluation process and the joint decision regarding the capital adequacy of cross border groups (CP39).

These Guidelines should be read in conjunction with the general framework developed by CEBS for the operational functioning of colleges, which was set out in draft Guidelines released for consultation on 17 December 2009.

The draft Guidelines provide tools to facilitate a common understanding within colleges of the results of assessments of material risks and control factors, the ICAAP processes and methodologies, as well as compliance with various minimum requirements of the CRD performed by national supervisors with reference to CEBS’s existing guidance on the Supervisory Review Process (SRP).  

CEBS expects its members to implement these Guidelines in conjunction with the implementation of the revised CRD which will come into force on 31 December 2010.

The consultation, which will run until 9 July 2010, is open to all interested parties, including supervised institutions and other market participants. CEBS organises a public hearing on its draft guidelines on liquidity cost benefit allocation

The Committee of European Banking Supervisors (CEBS) has published its consultation paper on draft guidelines on liquidity cost benefit allocation (CP36). The consultation is open to all interested parties, including supervised institutions and other market participants.

Following the publication of its advice to the European Commission on Liquidity Risk Management in September 2008 and the amendments to the Capital Requirements Directive issued in September 2009 (see the new Annex V) that call for “robust strategies, policies, processes and systems for the identification, measurement, management and monitoring of liquidity risk…” that “…shall also include adequate allocation mechanisms of liquidity cost, benefits and risks”, CEBS has committed to undertake further work on liquidity cost allocation.

The main objective of CEBS’s guidelines is to provide high-level guidance to the institutions on the main elements to be considered when creating or reviewing adequate fund allocation mechanisms including liquidity cost, benefits and risks. Thus, a liquidity cost concept that includes not only direct funding costs but also associated indirect costs such as liquidity contingency support is proposed.

The Committee of European Banking Supervisors (CEBS) has published its draft revised guidelines on aspects of the management of concentration risk under the supervisory review process. The consultation is open to all interested parties, including supervised institutions and other market participants.

The draft revised guidelines update the Guidelines on technical aspects of the management of concentration risk under the supervisory review process published on 14 December 2006 and complement the principles set out in the CEBS’s Guidelines on the application of the supervisory review process (GL03).

The Committee of European Banking Supervisors (CEBS) has launched a consultation on its draft guidelines for the operational functioning of colleges. The consultation is open to all interested parties, including supervised institutions and other market participants.

The revised Capital Requirements Directive (CRD) requires the establishment of supervisory colleges as an instrument for stronger coordination and cooperation whereby competent authorities reach agreement on key supervisory tasks. The colleges are expected to facilitate the handling of ongoing supervision and also to play a role in both the preparation for and handling of emergency situations.  This consultation paper responds to the requirements of the revised CRD according to which CEBS should elaborate guidelines for the operational functioning of colleges. In addition, the draft guidelines aim to complement the CRD provisions where additional guidance appears necessary in order to avoid inconsistencies and regulatory arbitrage, which could result from differences in the approaches and rules applied by the various colleges and the application of discretion by Member States.

The Committee of European Banking Supervisors (CEBS) has published the draft of its revised Guidelines on stress testing for consultation. The consultation is open to all interested parties, including supervised institutions and other market participants.

The revised guidelines update the Guidelines on Technical Aspects of Stress Testing under the Supervisory Review Process that were published on 14 December 2006 and complement the principles set out in the CEBS’s Guidelines on the Application of the Supervisory Review Process under Pillar 2.

The revised guidelines draw on the experience that supervisors have obtained by reviewing institutions’ stress tests in recent years, and take account of the revised principles for sound stress testing practices and supervision published by the Basel Committee of Banking Supervision (BCBS).

The Committee of European Banking Supervisors (CEBS) has launched a consultation on its draft guidelines on the management of operational risk in market-related activities. The consultation is open to all interested parties, including supervised institutions and other market participants.

Within the guidelines CEBS introduces more specific principles and implementation measures for the identification, assessment, control and monitoring of operational risk in market-related activities. CEBS draft principles are divided into three different parts, addressing the management of operational risk in market-related activities from three different angles:

• Governance mechanisms - principles 1-5;

• Internal controls - principles 6-15; and

• Internal reporting systems - principles 16-17.

In December 2009, the Committee of European Banking Supervisors (CEBS) published its consultation paper (CP33) on its implementation guidelines on capital instruments. The consultation is open to all interested parties, including supervised institutions and other market participants.

The revised Capital Requirements Directive (CRD) introduces explicit rules for the treatment of instruments eligible as capital and, in particular, requirements for their inclusion in institutions’ original own funds without limits. The amendments will need to be transposed into Member States’ national law by 31 October 2010 and will then be applied from 31 December 2010. This consultation paper is a response to Article 63a (6) of the revised CRD that requires CEBS to elaborate guidelines for the convergence of supervisory practices with regard to the instruments referred to in point (a) of Article 57.
